Terms of Service

These Terms and Conditions ("Terms") govern your use of the Rentbutik platform and set out your rights and obligations. We recommend that you read these Terms carefully before using the platform. By accessing or using the platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Definitions

The following terms, when used in these Terms, shall have the meanings set forth below:

"Account" means the personal user account created by a User on the Rentbutik Platform that enables the User to access and use the Platform's features.

"Platform" means the Rentbutik mobile application, website, and any other digital services that may be provided by Rentbutik from time to time.

"Application" means the Rentbutik mobile application.

"Content" means any text, photographs, documents, reviews, listings, or other information created, uploaded, shared, transmitted, or otherwise made available through the Platform.

"Rentbutik" means S2J Inc., the owner and operator of the Platform.

"User" means any natural person or legal entity that accesses, registers for, or uses any feature of the Platform.

"Host" means any natural person or legal entity that offers a vehicle owned by, or lawfully possessed by, such person or entity for rent through the Platform.

"Renter" means any natural person or legal entity that rents a vehicle through the Platform for temporary use.

"Vehicle" means any car or other vehicle offered for rent through the Platform.

"Rental Transaction" means an agreement entered into between a Host and a Renter through the Platform for the temporary rental and use of a Vehicle.

"Trip" or "Rental Period" means the period beginning when the Vehicle is delivered to the Renter and ending when the Vehicle is returned to the Host.

Introduction

Rentbutik (“Rentbutik”, “we”, or “us”), provides an online car sharing platform that connects vehicle owners with travelers and locals seeking to book those vehicles. Our mobile application, Rentbutik, provides a convenient and efficient way to find and book rental cars. Rentbutik is accessible online including at rentbutik.com and as an application for mobile devices. The Rentbutik website, blog, mobile applications, and associated services are collectively referred to as “the Services”. By accessing, using, or registering for the Rentbutik mobile application, you agree to be bound by these Terms of Condition. If you do not agree to these Terms of Condition, you may not use the Rentbutik mobile application.

These Terms, together with the cancellation policy, and applicable insurance terms and certificates constitute the “Agreement” between you and Rentbutik (each a “Party” and together, “the Parties”). In addition, Rentbutik, provides a Car Sharing Agreement that summarizes the terms of each reservation, accessible in the Services for any booked or previous trips and you may use it as proof of a reservation.

Modification. Rentbutik reserves the right, at our sole discretion, to modify the Services or to modify the Agreement, including these Terms, at any time. If we modify these Terms, we will post the modification on the Services. We will also update the “Last Revised” date at the top of these Terms. If you continue to access or use the Services after we have posted a modification or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified terms. If the modified terms are not acceptable to you, your sole recourse is to stop using and accessing the Services and close your Rentbutik Account within 30 days. If you choose to close your Rentbutik Account, the previous effective version of these Terms will apply to you, unless you use the Services during the intervening 30 day period, in which case the new version of these Terms will apply to you.

Platform Status and Intermediary Role

Rentbutik operates solely as a technology platform and intermediary service provider that facilitates the listing, booking, and rental of vehicles between Users.

All legal relationships arising from the listing, booking, rental, and use of a Vehicle are established directly between the Host and the Renter. Rentbutik is not a party to any rental agreement, contract, arrangement, or other legal relationship between the Host and the Renter and assumes no responsibility or liability for any obligations arising therefrom.

Rentbutik makes no representations or warranties regarding the condition, safety, roadworthiness, legality, availability, suitability, or fitness for any particular purpose of any Vehicle, nor does it guarantee the conduct, actions, omissions, identity, qualifications, or reliability of any User.

By using the Platform, Users acknowledge and agree that Rentbutik acts solely as a technology intermediary. To the fullest extent permitted by applicable law, Rentbutik shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, losses, disputes, personal injuries, property damage, delays, administrative penalties, legal claims, or other liabilities arising out of or relating to any rental transaction, the use of any Vehicle, or the conduct of any User. Rentbutik is not a party to the rental relationship between the Host and the Renter and shall not be responsible for the performance or enforcement of any obligations arising from such relationship.

Eligibility, registration, verification

Eligibility. Services are intended for individuals aged 18 or older. Any use of the Services by anyone that does not meet these eligibility requirements is expressly prohibited.

Registration. To access certain features of the Services, you must sign up for an account with us (a “Rentbutik Account”). You are responsible for maintaining the confidentiality of your Account login information and for all activities that occur under your Account. You agree to notify Rentbutik immediately of any unauthorized use of your Account. You can create a Rentbutik Account by providing us your first and last name, email address, mobile phone number, and creating a password. When you book a vehicle as a renter, you provide us with certain additional information about yourself. Similarly, when you list a vehicle as a vehicle owner or host (“host”), you provide us with certain additional information about yourself and your vehicle(s). You must provide accurate, current, and complete information during the registration, booking, and/or listing process. It is strictly prohibited to register or use the services with information belonging to another person, including but not limited to a driver’s license, ID card, passport, or any other identification documents. The user confirms that all information provided during registration is valid, accurate, and belongs to them personally. Rentbutik bears no responsibility for any traffic accidents, administrative or legal liabilities, fines, financial damages, or other violations arising from the use of false, misleading, or third-party information. In such cases, all legal and financial responsibility shall rest entirely with the user. You must keep your Rentbutik Account up to date at all times. Based on information you provide, Rentbutik may impose additional requirements for you to book a trip (e.g., providing a deposit, adding a second form of payment, buying a certain level of protection plan, or other requirements).

Verification. Where permitted, Rentbutik has the right, but not the obligation, to undertake screenings, checks, and engage in processes designed to help verify the identities or check the backgrounds of users, including driving history and driver’s license validity and verify vehicle details. Rentbutik does not endorse any vehicle, user, or a user’s background, or commit to undertake any specific screening process. Rentbutik may in its sole discretion use third-party services to verify the information you provide to us and to obtain additional related information and corrections where applicable, and you hereby authorize Rentbutik to request, receive, use, and store such information. Rentbutik may permit or refuse your request to book or list a vehicle in its sole and absolute discretion. Rentbutik may, but does not commit to, undertake efforts to ensure the safety of vehicles shared through the Services.

Fees, taxes, fines

Fees. The respective commission fee (15% + any potential Bank fees) is deducted from the payments we receive for using the services, and the remaining amount is paid to the Host. The commission fee is determined independently by Rentbutik. After the fees we receive for the use of services and other cost structures are paid to the Host, the Host is responsible for paying taxes and other mandatory fees determined by relevant legislation on that amount. You can verify the amount for your trip at checkout before you submit your trip request. Hosts can view earnings through Wallet Balance and learn more about earnings breakdown here. When you provide Rentbutik a payment method, you authorize Rentbutik, or third-party service providers acting on behalf of Rentbutik, to store your payment credential for future use in the event you owe Rentbutik any money. You authorize Rentbutik to use stored payment credentials for balances, including for Trip costs, host fees (e.g., late fees, security deposits, processing fees and claims costs, and related administrative fees). Rentbutik, may also report information about your Rentbutik Account to credit bureaus. As a result, late payments, missed payments, or other defaults on your Rentbutik Account may be reflected in your credit report.

Taxes. Rentbutik may enable the collection and remittance of certain taxes from or on behalf of renters or hosts, based on existing and future tax regulations, including marketplace facilitator or car sharing regulations. After the fees we receive for the use of services and other cost structures are paid to the Host, the Host is responsible for paying taxes and other mandatory fees determined by relevant legislation on that amount.

Fines. Users acknowledge and agree that they are solely responsible for any fines, penalties, citations, or fees incurred during the use of vehicles rented through Rentbutik's platform. This includes, but is not limited to, violations of traffic laws, parking regulations, toll violations, or any other infractions related to the use or operation of the rented vehicles. Users assume full liability for fines or penalties resulting from their actions, negligence, or failure to comply with local laws and regulations while utilising the rented vehicles. This liability extends to any fines incurred during the rental period, whether related to traffic violations, parking tickets, toll violations, or other violations. Users agree to promptly report any fines, penalties, citations, or legal notices received during the rental period to Rentbutik. Failure to report such incidents may result in additional charges or penalties. Rentbutik does not assume any responsibility for fines, penalties, citations, or legal fees incurred by users during the rental period.

Payments

Payment. When a car rental request is submitted, an amount of 0.05 AZN is blocked from the Renter's balance for verification purposes, and the amount is refunded to the renter`s balance when the car owner either accepts or cancels the request. The total amount for car rental is blocked from the Renter's balance after the query is accepted by the car owner. The renter has the right to cancel the trip for free within 1 hour after their request is accepted. If the trip is cancelled within the free cancellation period, the full amount will be refunded to the renter's balance; otherwise, according to the cancellation procedure, a penalty will be applied.

Deposit. When the request is accepted by the Host, a certain amount of deposit will be blocked from the renter's balance along with the daily cost of the car. The deposit acts as security to cover any potential fines, damage to the interior of the car, fuel, and similar expenses that may arise during the trip. After the trip is completed and the car is successfully handed over, the deposit amount will be refunded to the renter's balance.

Your commitments

You agree that you will always use your Rentbutik Account and the Services in compliance with these Terms, applicable law, and any other policies and standards provided to you by Rentbutik.

Account Activity. You are, and will be solely responsible for, all activity that occurs through your Rentbutik Account. Keep your Rentbutik Account information, including your password, secure. You agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your Rentbutik Account, whether you have authorized such activities or actions. You will immediately notify Rentbutik of any actual or suspected unauthorized use of your Rentbutik Account. We are not responsible for your failure to comply with this clause, or for any delay in shutting down or protecting your Rentbutik Account unless you have reported unauthorized access to us.

Content

User Content. We may, in our sole discretion, permit you to post, upload, publish, submit or transmit content through the Services such as photographs of you and your vehicle(s), reviews, feedback, and descriptions of you, your vehicle, or trip. Users are solely responsible for the User Content they submit or post on Rentbutik.

User Responsibilities. Users affirm that they have all necessary permissions, rights, and consents to share their User Content and that the User Content does not violate any third-party rights or infringe upon any applicable laws.

Content Guidelines: Rentbutik reserves the right to moderate, remove, or refuse any User Content that violates these Terms of Service or community guidelines, or that Rentbutik believes, in its sole discretion, is inappropriate or unlawful. Users may not upload or share User Content that is defamatory, offensive, discriminatory, infringing, or otherwise objectionable.

Termination of User Content. Rentbutik reserves the right to remove or disable access to any User Content without notice, at its sole discretion. Rentbutik may also terminate or suspend a User's account if they repeatedly violate these Terms of Service or infringe upon others' rights through their User Content.

Feedback. Users may provide feedback, suggestions, or ideas to Rentbutik regarding the services. Rentbutik may use, modify, adapt, publish, and distribute such feedback for any purpose.

Vehicle Cleanliness and Return Condition

The Renter shall return the Vehicle in substantially the same condition in which it was received, subject to reasonable wear and tear, and with a reasonable level of cleanliness.

Except for normal wear and tear resulting from ordinary use, the Renter shall be responsible for any excessive dirt, staining, unpleasant odors, animal hair, litter, spills, or any other condition affecting the interior or exterior of the Vehicle that requires cleaning beyond standard post-rental preparation.

If additional cleaning is required, the Renter may be charged the actual cost of the cleaning service or the applicable cleaning fee determined by Rentbutik. Such amount may be deducted from the Security Deposit or otherwise charged to the Renter in accordance with these Terms.

Rentbutik and/or the Host reserve the right to document the condition of the Vehicle and any circumstances requiring additional cleaning by means of photographs, videos, or other reasonable evidence.

Copyright Protection

Rentbutik respects intellectual property rights and expects its users to do the same. All content and materials available on the Rentbutik platform, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, are the property of Rentbutik or its licensors and are protected by copyright laws. Users are granted a limited, non-exclusive, revocable licence to access and use Rentbutik's services for personal and non-commercial use. This licence does not permit users to modify, reproduce, distribute, display, or create derivative works based on Rentbutik’s content without explicit permission. Users agree not to infringe upon the intellectual property rights of Rentbutik or any third party. Users must not upload, post, transmit, or otherwise make available any content that infringes upon copyrights, trademarks, patents, trade secrets, or any other proprietary rights. Rentbutik respects the intellectual property rights of others. If users believe their copyrighted work has been copied or used in a way that constitutes copyright infringement, they should notify Rentbutik and provide the necessary information. Upon receiving a valid copyright infringement notice, Rentbutik will investigate the claim and may take appropriate action, including removing or disabling access to the allegedly infringing content. Repeat infringers of copyright will have their accounts terminated. Rentbutik reserves the right to remove any content that is alleged to infringe upon someone else's copyright without prior notice and at its sole discretion.

Prohibited activities

Illegal Activities. Users must not use Rentbutik for any unlawful, fraudulent, or unauthorised purpose, including but not limited to violating any local, state, national, or international laws or regulations.

Abusive Behaviour. Users shall not engage in abusive, harassing, threatening, discriminatory, or defamatory conduct towards other users, Rentbutik staff, or any third parties.

Misuse of Platform. Users must not manipulate or interfere with Rentbutik’s services, including introducing viruses, trojans, worms, logic bombs, or other malicious or technologically harmful materials.

False Information. Users are prohibited from providing false, misleading, or inaccurate information when registering an account, making bookings, or using Rentbutik’s services.

Impersonation. Users shall not impersonate any person or entity, or falsely state or misrepresent their affiliation with a person or entity.

Data Mining and Scraping. Users must not attempt to extract, scrape, or collect data from Rentbutik’s platform, including but not limited to user data, listings, or any other information available on the site, without authorization.

Commercial Use without Authorization. Users shall not use Rentbutik for commercial purposes, including advertising or soliciting goods or services, without prior written consent.

Harm to the Platform. Users must not engage in any activity that could harm, disable, overburden, or impair the proper functioning of Rentbutik’s services or networks.

Violation of Terms. Users agree not to violate any of Rentbutik’s terms, policies, or guidelines, as outlined in these Terms of Service or elsewhere on the platform.

Other legal matters

Violations. Rentbutik has the right, but not the obligation, to investigate reported violations and take appropriate action, which may include removing content, suspending or terminating user accounts, or involving legal authorities as necessary.

Communicate with you. You agree that Rentbutik may contact you by electronic means (e.g., electronic mail; notifications via Rentbutik messaging; app notification) in lieu of any requirement for mailed notices. To contact you more efficiently, you agree that we may, at times, also contact you using autodialed or prerecorded message calls or text messages at your phone number(s). We may place such calls or texts to confirm your signup, provide notices regarding your Rentbutik Account or Rentbutik Account activity, investigate or prevent fraud, collect a debt owed to us or recover unpaid invoices, or communicate urgent messages. We may share your phone number(s) with service providers with whom we contract to assist us in pursuing these interests. We will not share your phone number(s) with third parties for their own purposes without your consent. You agree that Rentbutik may contact you on any day, at any time of day, and in relation to the above purposes.

User Responsibility and Indemnification

Users acknowledge and agree that they are solely responsible for all activities conducted through their use of the Rentbutik Platform, including the information they provide, their use of any Vehicle, and their interactions and legal relationships with third parties.

To the fullest extent permitted by applicable law, if any claim, demand, lawsuit, administrative proceeding, fine, penalty, loss, damage, cost, expense, or other liability is asserted against or incurred by Rentbutik, its directors, officers, employees, representatives, affiliates, partners, or agents as a result of a User's acts or omissions, inaccurate or misleading information, use of a Vehicle, violation of applicable law, or breach of these Terms, the User agrees to defend, indemnify, and hold harmless Rentbutik and such persons from and against all resulting losses, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, to the extent permitted by applicable law.
